THE FLEXIROC T30 R TRY-AND-BUY SPECIAL GIVEAWAY PROMOTION RULES:

The FlexiROC T30 R Try-and-Buy Special Giveaway Promotion (the “Giveaway”) is sponsored by Epiroc USA LLC (“Sponsor”). As a condition of participating in the Giveaway, you agree to be fully and unconditionally bound by these Official Rules and the decisions of Sponsor, whose decisions shall be final and binding in all respects, and to waive any right to claim ambiguity in the Giveaway, these Official Rules, any advertising materials or information contained on Sponsor’s social media and websites. The Giveaway is subject to applicable federal, state, and local laws and regulations and is VOID WHERE PROHIBITED OR RESTRICTED BY LAW. Receiving a Free Gift (as defined below) is contingent upon fulfilling all requirements set forth herein.

Start and End Date. The Giveaway starts at 8 am Eastern Standard Time (“EST”) September 15, 2020 and ends at 11 pm EST on November 30, 2020, or while supplies last, whichever is earlier (“Giveaway Period”). All field demo requests must be submitted at https://www.miningandconstructionusa.com/flexiroc-t30r or to an Epiroc Representative by 11 pm EST on November 30, 2020, or while supplies last, whichever is earlier.

Free Gift Eligibility. NO PURCHASE IS NECESSARY TO PARTICIPATE IN THE GIVEAWAY. While supplies last, end-users of Epiroc equipment who are: (1) of twenty-one (21) years of age and older; (2) are a resident of the continental United States, excluding residents of Alaska and Hawaii; and (3) are currently living in the U.S. (each a “Customer Representative”) may receive the Free Gift (as defined below) upon completion of the FlexiROC T30 R Construction Edition Try-and-Buy field demo, which consists of up to 30 engine hours at one job site of the Customer Representative (the “Demo”). Typical Demo starts at 8 am on Tuesday local time and ends at 5 pm on Thursday of the same week local time.

THE DEMO IS SUBJECT TO FINAL EPIROC APPROVAL AND ADDITIONAL TERMS AND CONDITIONS. PLEASE SPEAK WITH AN EPIROC REPRESENTATIVE FOR COMPLETE DETAILS REGARDING THE DEMO.

Demo requests that fail to provide required information indicated in the online form or Try-and-Buy Demo request form will be considered ineligible.

How to Receive Your Free Gift. During the Giveaway Period and while supplies last, a Customer Representative may visit https://www.miningandconstructionusa.com/flexiroc-t30r and enter their information and that of their employer, which utilizes Epiroc equipment (the “Customer”) or complete a Try-and-Buy form provided by Customer’s Epiroc Representative and submit the form to the Epiroc Representative.

The first thirty (30) Customer Representatives that register, as described above, and whose employing Customer completes a Demo will receive one (1) Apple AirPods with Wireless Charging Case (the “Free Gift”) with an approximate retail value (“ARV”) of $169.00. The Free Gift is awarded upon completion of the Demo to the Customer Representative who submitted the Try-and-Buy Demo request form, subject to the employing Customer’s approval.

Gift Restrictions. Limit one (1) Free Gift per Customer Representative whose employing Customer completes a Demo pursuant to the Free Gift Offer. Only one (1) Customer Representative for each Customer is eligible. No Free Gift transfers, substitutions or cash equivalents will be offered, except at the sole discretion of the Sponsor. If a Free Gift becomes unavailable, Sponsor reserves the right to substitute a gift of equal or greater value. The Free Gift offer is only valid while supplies last. At no point will more than thirty (30) Apple AirPods be awarded to Customer Representatives whose employing Customer successfully complete a Demo as required in these Giveaway Rules.

At-Purchase Offer. If at the end of the Demo, Customer chooses to purchase the FlexiROC T30 R Construction Edition used during the Demo, the Customer may select either:

(1) 0% financing for twelve (12) or eighteen (18) months or longer financing terms up to sixty (60) months at the special rate as specified in Schedule A. Financing will be through Epiroc Financial Services USA LLC (“EFS”) of the list purchase price up to a maximum of $15,000 value (based on savings from market rate [or stated index] at the time of financing), subject to Epiroc and EFS approval in their sole discretion, including based on Customer credit approval, or

(2) a consumables package including FlexiROC T30 R rods and drill bits as specified in Schedule A attached hereto, with an ARV up to $8,000. The ARV of the consumables package is based on full retail prices of Epiroc drilling consumables.

The delivery terms for the consumables package are at Sponsor’s discretion and all consumables are provided AS-IS. The financing savings are based on EFS Q3 2020 rates: 12 months @ 6.5%, 24 months @ 5.25% subject to credit approval in Epiroc/EFS’s sole discretion. Each purchase of a FlexiROC T30 R Construction Edition is limited to either the financing offer or the consumables package described above. The financing offer may not be used with a different purchase and the consumables package is non-transferrable. If the consumables package becomes unavailable, Sponsor reserves the right to substitute an offer of equal or greater value. No trade-ins are allowed. Demo is not necessary to qualify for an at-purchase offer if the customer chooses to purchase FlexiROC T30R Construction Edition before the end date of Try-and-Buy Special Giveaway Promotion.

ALL SPECIAL FINANCING FOR CUSTOMERS OR EPIROC DISTRIBUTORS ARE SUBJECT TO AN EPIROC AGREEMENT WHICH INCLUDES CREDIT APPROVAL.

Liability Disclaimer. As a condition of participating in the Giveaway, Customer agrees that: (1) Sponsor is not responsible for Try-and-Buy Demo request submissions not forwarded by participating individuals, or Try-and-Buy Demo request submissions that are lost, late, illegible, misdirected, damaged, or incomplete; (2) Sponsor is not responsible for any damages or liabilities resulting from the Giveaway, the Demo or the acceptance and use of any gifts awarded; (3) any and all disputes, claims and causes of action arising out of or connected with this Giveaway, the Demo, or any gifts awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration; and (4) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys’ fees.
